High Court Upholds Meru Governor Kawira Mwangaza’s Impeachment

The High Court has upheld the impeachment of Meru Governor Kawira Mwangaza, affirming the Senate’s decision to remove her from office. Justice Bahati Mwamuye dismissed Mwangaza’s petition, stating that the impeachment process adhered to constitutional procedures. The court found that Mwangaza was given ample opportunity to present her defense and that the allegations of procedural unfairness and chaos during the Senate proceedings were unsubstantiated.

The Senate had previously upheld charges against Mwangaza, including gross violation of the constitution, gross misconduct, and abuse of office. On August 21, 2024, 26 senators voted in favor of her impeachment, with 14 abstentions and four votes against. Speaker Amason Kingi announced that, pursuant to Article 181 of the Constitution, Mwangaza ceased to hold office.

Following the High Court’s ruling, Meru Deputy Governor Isaac Mutuma M’Ethingia is expected to assume the role of acting governor unless a stay order is secured. Mwangaza’s legal team had previously obtained conservatory orders in December 2024, extending her tenure for 120 days, but these have now been overturned.
