High Court Halts Investigations into Nairobi Hospital Affairs

The High Court has temporarily suspended further investigations into The Nairobi Hospital’s operations, including efforts to access sensitive data and freeze bank accounts of its senior management. Justice John Chigiti issued the directive, halting actions by investigative agencies pending a judicial review.

The Kenya Hospital Association (KHA), which manages The Nairobi Hospital, challenged the probe, arguing that it violated patient confidentiality as protected under the Health Act 2017 and the Data Protection Act. They contended that the investigation was politically motivated, aiming to intimidate officials amid internal leadership disputes.

Previously, Attorney General Dorcas Oduor had secured court orders authorizing detectives to seize documents and electronic devices from the hospital. However, the High Court has now suspended the enforcement of these search orders and set a hearing for April 7, 2025, to determine the way forward.

In response to the court’s ruling, The Nairobi Hospital reaffirmed its commitment to upholding the law while safeguarding patient privacy. The institution emphasized its dedication to transparency and accountability, ensuring that patient care remains uninterrupted during this period.
