Crackdown Targets Unregistered Churches in Nyanza Region

Flora Mworia, the Nyanza Regional Commissioner, has announced a comprehensive crackdown on unregistered churches operating within the region, encompassing Kisumu, Siaya, Homa Bay, Migori, Kisii, and Nyamira counties. This initiative is part of a broader national effort to regulate religious organizations and curb the proliferation of unregistered entities.

The crackdown aligns with the provisions of the Religious Organisations Bill, 2024, which stipulates stringent requirements for the registration and operation of religious organizations. Under this bill, individuals operating unregistered churches face penalties including fines up to KSh 5 million, imprisonment for up to three years, or both. Additionally, the bill mandates that religious organizations maintain transparent financial records and undergo regular inspections to ensure compliance with established regulations.

This move follows several incidents highlighting the risks associated with unregistered religious organizations. Notably, in June 2023, a raid at the Holy Ghost Coptic Church in Kisumu led to the rescue of eight individuals who were being held in deplorable conditions. The church, operated by Archbishop Father John Pesa, lacked the necessary licenses to detain individuals for religious purposes, prompting calls for stricter oversight of religious institutions.

The government’s decision to intensify scrutiny of religious organizations has sparked debates among religious leaders. In Kisii County, church leaders have expressed opposition to the proposed regulations, arguing that such measures infringe upon the autonomy of religious institutions and may hinder their charitable activities. Similarly, clerics in Homa Bay have voiced concerns that the Religious Organisations Bill could undermine the freedom of worship, emphasizing that religious groups should be self-regulating rather than subject to governmental control.

Despite these objections, the government remains committed to enforcing the new regulations, aiming to ensure that all religious organizations operate within the legal framework and uphold the safety and well-being of their congregants.

As the crackdown progresses, authorities in Nyanza are urging all religious organizations to verify their registration status and comply with the legal requirements to avoid potential legal consequences.
