The footage, captured during a house party in Eldoret in 2019, shows the accused, lawyer Abel Mogaka, engaging in a violent altercation with his colleague, Calvin Ngaira, which led to Ngaira’s death.
The case has faced numerous delays, partly due to the absence of crucial evidence. In August 2024, the court issued a warrant for the arrest of DCI cybercrime officer Daniel Kieni for allegedly withholding vital evidence, including the CCTV footage. Justice Robert Wananda criticized the officer’s failure to present the evidence, noting that such actions contribute to delays in the judicial process.
