MPs Push for Constitutional Amendment to Secure Key Development Funds

The National Assembly of Kenya initiated the process to amend the Constitution to permanently entrench three pivotal funds: the National Government Constituency Development Fund (NG-CDF), the Senate Oversight Fund (SOF), and the National Government Affirmative Action Fund (NGAAF). This action follows a series of legal challenges, including a High Court ruling that declared the NG-CDF unconstitutional, with operations set to cease by June 30, 2026 .

The proposed constitutional amendment is spearheaded by Ainabkoi MP Samuel Chepkonga and Rarieda MP Otiende Amollo. They have introduced the Constitution of Kenya (Amendment) Bill, 2025, which aims to anchor these funds in the Constitution, thereby providing them with a solid legal foundation and ensuring their continued operation

The joint parliamentary committee tasked with this initiative comprises eight MPs from the National Assembly, including co-chairpersons Chepkonga and Amollo. Additionally, nine senators will be appointed to the committee, which is expected to report back within 90 days to determine the next steps in the legislative process.

This move has sparked a debate between lawmakers and governors. While MPs argue that entrenching these funds will enhance service delivery and empower marginalized communities, governors express concerns that such an amendment could infringe upon the functions of devolved units and lead to duplication of services
